Situations ::If you are arrested abroad ?


Try your best not to lose your cool and self-confidence. Remain calm throughout the proceedings despite the adversity of circumstances. Remember: Being nervous or agitated is not going to help or improve the situation. Think how best you can help yourself to get out of the situation or minimize the damage.

Insist on informing your embassy/High commission or your local contacts immediately and give details of the place of detention etc.

You are entitled to have the services of a lawyer and ask for it if you think the circumstances warrant.

Give straightforward and factually correct answers to all the questions asked by the arresting agency or any other authority. Do not appear to be evasive or offensive. Give information only to the extent that you are sure of its accuracy or authenticity. If you do not know, then say so. If you are not sure of something, then qualify your statement accordingly. But at no point should you say something as a fact, which is found to be incorrect later.

Ask for being released on your personal bond or on bail as per the law of the land.

You may be asked to sign a memo listing out your personal belongings and any other articles recovered from you on your personal search after the arrest. Check the list carefully to ensure that it contains all the items recovered and does not show any extra item that may be incriminating.

Do not sign any paper without reading and properly understanding them. Without appearing to be fussy, you can politely ask for clarifications.

If you apprehend any physical threat or injury at the hands of the arresting agency, ask for a medical examination before any harm is caused to you. You may also express your apprehensions to the judicial authority when you are produced before them.

Check your belongings thoroughly when returned to you at the time of signing your release papers. If the arresting authority is retaining any of the articles recovered from you, ask for a proper receipt from them.

Inform your embassy/high commission as also any other local contact about your release from custody
